Another twist to the story… The Court in Nashville has ruled against Tim McGraw in his on-going battle with his previous (or should that now be current?) record label Curb Records.

The publicity statement released by the label’s publicist today, states that the Court ruled that McGraw breached his contract with Curb, is effectively still under contract with them, and that the Court of Appeals will soon rule whether to order an injunction against the singer. If granted, this could make things even messier than they already are. Curb released the statement to “set the record straight and make clear why there is a lawsuit with Tim.”

The suit centers around McGraw’s Emotional Traffic album. Curb contends that the record did not meet the terms of his contract, could not be considered his Fifth Option Period Album, and therefor leaves him still as a Curb artist. Furthermore, Curb says that the new music McGraw has recorded since then – around 20 songs – belong to Curb, and not to McGraw’s new label, Big Machine Records.

The Court has also granted Curb’s request to postpone the trial, which was due to start next month, until the label has had time to investigate the legality of the Big Machine signing, and the time frame of when the new music was recorded.

Outlined in the press release are Curb Records’ beliefs that:

  • Tim McGraw is still an artist on Curb Records’ label;
  • That Big Machine had no right to sign Tim McGraw until his contract with Curb Records is over;
  • That the “new music” advertised by Tim McGraw and Big Machine, or that Big Machine may choose to release before the Court ruling, is still owned by Curb Records;
  • When the Court does rule, it will agree that Tim McGraw has breached his Recording Agreement with Curb Records.

Last week, Curb announced it was sending a new single, ‘Right Back Atcha Babe,’ to radio. Just days later, Big Machine Records followed this by announcing the July 3rd release of ‘Truck Yeah,’ the first single from his planned upcoming Big Machine label debut. The press release did not comment on how ‘Truck Yeah’ might be affected by the legal proceedings.
